By downloading, installing, or using the THOM application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the App. These Terms constitute the entire agreement between you and Solum Enterprise LLC ("Company", "we", "us") regarding your use of the App.
THOM is a mobile application designed for professional drivers. It provides informational content about traffic regulations, driving activity records, tachograph assistance, GPS tracking, and an AI-powered assistant for transport-related queries. The App is provided for informational purposes only.
You may use the App with or without registration. Unregistered users may access basic features; registered users gain access to personalized features and data storage. You agree to use the App only for lawful purposes and in a manner consistent with these Terms. We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice, at our sole discretion.
The AI Co-Driver feature uses a token system. Each user receives 5,000 free tokens monthly, automatically renewed on the 1st of each month. Additional tokens may be purchased within the App. Purchased tokens do not expire. Tokens have no monetary value, are non-transferable, and may not be exchanged for cash. All purchases are final, subject to the Refund Policy below.
All content provided through the App is for informational purposes only. We make no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, or timeliness of any information. Traffic regulations, fines, and tolls are subject to change by competent authorities at any time without notice. Users are solely responsible for verifying current regulations before travel.
The AI Co-Driver provides responses based on available data and artificial intelligence models. Responses are informational only and do not constitute legal, professional, or regulatory advice. We are not liable for any actions taken or decisions made based on AI Co-Driver responses.
To the fullest extent permitted by applicable law, Solum Enterprise LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to fines, penalties, data loss, or loss of revenue. The App does not replace any legally required device, including the digital tachograph.
All content, features, and functionality of the App — including text, graphics, logos, icons, images, software, and data — are the exclusive property of Solum Enterprise LLC or its licensors and are protected by applicable intellectual property laws worldwide. Unauthorized use is strictly prohibited.
You may stop using the App at any time by deleting your account or uninstalling the App. We reserve the right, at our sole discretion, to suspend or permanently terminate your access to the App for any reason, including violation of these Terms, without notice or liability.
We reserve the right to update or modify these Terms at any time at our sole discretion. We will notify users of material changes through the App. Your continued use of the App following any changes constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in Wyoming, USA, on an individual basis. You waive any right to participate in class action proceedings.
